SurveyKiller — Acceptable Use Policy
Effective date: August 31, 2026
This Acceptable Use Policy ("AUP") governs use of SurveyKiller (the "Service"), operated by Eigenlume LLC, and is part of our Terms of Service. Capitalized terms not defined here — including "Service," "Your Content," and "Respondent" — have the meanings given in the Terms. This AUP applies to everyone who uses the Service: account owners, organization members, and Respondents. If you violate it, we may suspend or terminate access (see Enforcement below).
You may not use the Service to:
Break the law or harm others
- Violate any law or regulation, or facilitate illegal activity.
- Infringe intellectual-property, privacy, publicity, or other rights.
- Post or transmit malware, or run surveys designed to phish, defraud, or deceptively harvest credentials or personal data.
- Harass, threaten, defame, or promote violence or hatred against others.
Misuse personal data
- Collect personal information from Respondents without a lawful basis and any required notices or consents, or otherwise in violation of privacy law.
- Collect government-issued identification numbers (including Social Security numbers), full payment card numbers, health or medical information, biometric identifiers, precise geolocation, information about children under 13, or other specially regulated data, except as permitted under Section 6.6 of the Terms.
- Use Respondent data for purposes beyond what you disclosed to Respondents.
- Build profiles or datasets for unlawful surveillance or discrimination.
Send spam or deceptive messages
- Send unsolicited survey invitations or other spam, or violate anti-spam laws (for example, CAN-SPAM) when emailing contacts. You must have a lawful basis to contact everyone on a list you upload, and you must honor opt-outs.
- Upload contact lists you do not have permission to use.
- Misrepresent who is sending a survey or what it is for.
Abuse the platform
- Attempt unauthorized access to the Service, other accounts, or our systems, or probe or security-test the Service without our prior written permission.
- Circumvent or manipulate plan limits, response caps, metering, AI allotments, or billing — including creating multiple accounts to evade pooled usage limits, or automating activity to inflate or evade usage.
- Scrape the Service, resell or sublicense it, or use it to build a competing product, except as permitted by law.
- Overload or interfere with the Service (excessive load, denial-of-service, or similar).
- Abuse AI features — for example, prompt injection, attempting to extract other customers' data or our system prompts, or generating content that violates this AUP.
Mistreat Respondents (core principle)
- Never charge, paywall, or upsell a Respondent to complete a survey. Respondents never pay — including for AI-assisted answering, which is always funded by the survey owner's plan.
- Do not deceive Respondents about who you are or how their answers will be used.
Enforcement
We may investigate suspected violations and take the action we reasonably consider appropriate: removing content, throttling features, or suspending or terminating accounts — with or without notice, depending on severity, urgency, and legal risk. We may report unlawful activity to law enforcement or other authorities. If you believe we acted in error, contact support@surveykiller.com and we will review.
